On the morning of April 9, 2026, in Hanoi, the National Data Center organized a seminar to collect feedback on the Draft Decree on Administrative Sanctions in the Field of Data. The seminar was chaired by Colonel Pham Minh Tien, Deputy Director of the National Data Center.

The seminar brought together representatives from ministries, agencies, localities, experts, and scientists, who engaged in discussions and provided feedback on key issues to refine the draft Decree.

At the seminar, delegates reached a high consensus on the necessity of issuing the Decree in the context of increasingly frequent and complex data-related violations, including cross-border elements, which affect the legitimate rights and interests of organizations and individuals, as well as the effectiveness of state management and social security and safety.

Regarding constitutionality, legality, and consistency of the draft, delegates proposed further review to ensure alignment with the existing legal system, particularly regulations on cybersecurity, personal data protection, and specialized sectors. They also emphasized the need to clarify the scope of application to avoid overlaps or omissions in handling violations.

For the system of violations and sanctions, opinions suggested refining the description of each violation’s elements, ensuring clarity on the subject, act, level of violation, and consequences or potential risks. Delegates recommended a coherent combination of principal sanctions, supplementary sanctions, and remedial measures.

On sanctioning authority and coordination mechanisms, delegates stressed the importance of clarifying the authority to record violations and impose sanctions; mechanisms for inter-agency coordination; procedures for transferring case files, verifying electronic evidence, and handling cross-border or multi-party situations.

Concluding the seminar, Colonel Pham Minh Tien stated that the drafting agency will fully incorporate the feedback to further improve the draft Decree in a rigorous, consistent, and feasible manner. The Decree will ensure comprehensive reflection of the data lifecycle structure, establish sanctioning mechanisms proportionate to the level of violations and risks, and clarify authority, coordination mechanisms, and enforcement conditions.
